TERMS OF SERVICE

These Terms of Service constitute a legally binding agreement between you and TrinitariaVPN governing your access to and use of the TrinitariaVPN mobile application and related services.

1. ACCEPTANCE OF TERMS

Welcome to TrinitariaVPN. These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and TrinitariaVPN (“we”, “us”, or “our”) governing your access to and use of the TrinitariaVPN mobile application and related services (collectively, the “Service”).

By downloading, installing, or using the TrinitariaVPN application, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

2. SERVICE DESCRIPTION

TrinitariaVPN provides a Virtual Private Network (VPN) service that:

  • Encrypts your internet traffic using industry-standard encryption protocols (including WireGuard, OpenVPN, and IKEv2);
  • Routes your connection through our global network of servers across multiple countries;
  • Helps protect your online privacy by masking your IP address;
  • Provides features such as split tunneling, threat protection, double hop (multi-hop) connections, and kill switch functionality.

We strive to provide reliable and fast VPN connectivity; however, we do not guarantee uninterrupted, error-free, or completely secure service at all times. Connection speeds may vary depending on server load, your internet service provider, network conditions, and geographic location.

3. ACCOUNT REGISTRATION AND ELIGIBILITY

3.1 Eligibility

You must be at least 18 years of age to create an account and use the Service. By registering, you represent and warrant that you meet this age requirement.

3.2 Account Information

When registering for an account, you must provide accurate, current, and complete information, including a valid email address and a secure password. You are responsible for maintaining the confidentiality of your account credentials.

3.3 Account Security

You are solely responsible for all activities that occur under your account. You agree to notify us immediately at support@trinitaria.tech if you become aware of any unauthorized use of your account.

3.4 One Account Per User

Each account is intended for use by a single individual. You may not share your account credentials with others or allow multiple people to use a single account, except as permitted by your subscription plan’s device limits.

4. ACCEPTABLE USE POLICY

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to use the Service to:

  • Engage in any activity that violates any applicable local, national, or international law or regulation;
  • Transmit, distribute, or store material that infringes upon the intellectual property rights of any third party;
  • Send spam, phishing emails, or other unsolicited communications;
  • Distribute malware, viruses, or any other harmful software;
  • Engage in hacking, unauthorized access to systems, or any form of cyber attack;
  • Engage in child exploitation or distribute child sexual abuse material (CSAM);
  • Harass, threaten, stalk, or abuse any person;
  • Interfere with or disrupt the Service, servers, or networks connected to the Service;
  • Attempt to gain unauthorized access to any part of the Service or any systems or networks connected to the Service;
  • Use the Service for any fraudulent or deceptive purpose;
  • Resell, sublicense, or otherwise commercially exploit the Service without our express written consent.

We reserve the right to suspend or terminate your account if we reasonably believe you are violating this Acceptable Use Policy.

5. PAYMENT TERMS

5.1 Subscription Plans

TrinitariaVPN offers subscription-based plans, including weekly, monthly, and annual options. Pricing is displayed in Dominican Pesos (RD$) and is subject to change with prior notice.

5.2 Free Trial

We may offer a free trial period of seven (7) days for new subscribers on eligible plans (currently monthly and yearly). Free trials are limited to one per person. At the end of the free trial, your selected subscription plan will automatically begin and your payment method will be charged unless you cancel before the trial period ends.

5.3 Cancellation During the Free Trial

You may cancel the free trial at any time before it ends through your account settings. If you cancel during the trial:

  • Your VPN access ends immediately upon cancellation. Because no payment has been made during the trial, no partial period is retained.
  • Your account enters a 14-day recovery window. During this window you can log back in and purchase a plan without needing to create a new account.
  • If you do not purchase a plan within 14 days of cancellation, your account is automatically anonymized. See our Privacy Policy for what “anonymized” means in this context.

5.4 Payment Processing

Payments are processed through Azul, a licensed payment processor operating in the Dominican Republic. By providing your payment information, you authorize us (through Azul) to charge the applicable subscription fees to your designated payment method. Google Pay (on Android) and Apple Pay (on iOS) are also supported and are likewise settled through Azul. For more details, please read the Azul Privacy Policy.

5.5 Recurring Billing

Subscriptions renew automatically at the end of each billing cycle (weekly, monthly, or annually) unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings or by contacting us. If you cancel during a paid period, you keep access to the Service until the end of the period you have already paid for; no refund is issued for the remaining time.

5.6 Failed Renewals and Past-Due Handling

If a recurring charge fails, your subscription is marked past-due:

  • Your VPN access is suspended until a successful charge restores it.
  • You have fourteen (14) days from the failure date to update your payment method and manually trigger a retry inside the app. We do not automatically retry a failed charge.
  • On day seven (7) of the past-due window we send you a reminder email.
  • If no successful charge occurs within fourteen (14) days of the failure, your account is automatically anonymized under the same process described in Section 5.3.

5.7 No Refunds

TrinitariaVPN does not currently offer refunds. You are billed only for periods you have started; you can cancel at any time to prevent future charges. If you cancel during a paid period, you keep access for the remainder of the period you have already paid for.

5.8 Trial Abuse Prevention

To keep the free trial available to genuine first-time users, we employ automated mechanisms to detect attempts to repeatedly claim a free trial with different email addresses. If our systems recognize that a card or email has already been used to start a free trial, we may require you to purchase a plan without a trial. Details of how these mechanisms work, and the anonymous data they store, are described in our Privacy Policy.

5.9 Price Changes

We reserve the right to modify our subscription pricing. Any price changes will be communicated to you at least thirty (30) days in advance and will apply to the next billing cycle following the notice.

6. PRIVACY

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the practices described in our Privacy Policy.

We are committed to a strict no-logs policy regarding your VPN browsing activity. We do not monitor, record, or store your online browsing history, traffic destination, data content, or DNS queries while connected to our VPN servers.

7. THIRD-PARTY SERVICES

To operate and deliver the Service, we rely on the following trusted third-party service providers. By using the Service, you acknowledge that your data may be processed by these providers in accordance with their respective privacy policies:

  • Supabase. We use Supabase as our backend infrastructure for account management, data storage, and user preferences syncing. For more details, please read the Supabase Privacy Policy.
  • Azul. We use Azul as our payment processor to handle and store payment transactions. For more details, please read the Azul Privacy Policy.
  • Resend. We use Resend as our email service provider for account-related communications, including password reset codes, account confirmations, and support notifications. For more details, please read the Resend Privacy Policy.

We are not responsible for the privacy practices or content of these third-party services. We encourage you to review their privacy policies.

8. INTELLECTUAL PROPERTY

8.1 Ownership

The Service, including the TrinitariaVPN application, its design, features, content, trademarks, logos, and all related intellectual property, are owned by or licensed to TrinitariaVPN and are protected by intellectual property laws of the Dominican Republic and international treaties.

8.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the TrinitariaVPN application on your personal devices solely for your personal, non-commercial use.

8.3 Restrictions

You may not: (a) copy, modify, or create derivative works of the Service; (b) reverse engineer, decompile, or disassemble the application; (c) remove or alter any proprietary notices or labels; or (d) use our trademarks without prior written consent.

9. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
  • WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE;
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT OR INFORMATION PROVIDED THROUGH THE SERVICE.

YOU ACKNOWLEDGE THAT NO VPN SERVICE CAN GUARANTEE ABSOLUTE SECURITY OR ANONYMITY ONLINE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRINITARIAVPN, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  • YOUR USE OF OR INABILITY TO USE THE SERVICE;
  • ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA OR TRANSMISSIONS;
  • ANY THIRD-PARTY CONDUCT ON THE SERVICE;
  • ANY OTHER MATTER RELATING TO THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. TERMINATION

11.1 Termination by You

You may terminate your account at any time by canceling your subscription and ceasing to use the Service. Cancellation does not entitle you to a refund. See Section 5.3 (cancellation during the free trial) and Section 5.5 (cancellation during a paid period) for how each state is handled.

11.2 Termination by Us

We may suspend or terminate your account and access to the Service at any time, with or without cause and with or without notice, including if we reasonably believe that you have violated these Terms or the Acceptable Use Policy.

11.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. Sections 7, 8, 9, 10, 12, and 13 shall survive termination.

12. GOVERNING LAW AND DISPUTE RESOLUTION

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Dominican Republic, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may submit the dispute to the competent courts of the Dominican Republic.

13. CHANGES TO THESE TERMS

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms within the application and updating the “Last updated” date at the top of this document. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically to stay informed about our terms and conditions.

14. MISCELLANEOUS

14.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and TrinitariaVPN regarding the Service and supersede all prior agreements.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
